As Anthropic Fights Trump, China Steals Its AI Capabilities

Real Clear Defense  |  Scott Gureck

The Trump Administration in mid-June imposed strict export controls on Anthropic’s advanced Mythos 5 and Fable 5 artificial intelligence models over national security concerns, triggering a major domestic legal and political dispute that threatens American technological leadership against China. This regulatory restriction followed intelligence reports indicating that the proprietary systems could be jailbroken to enable offensive cyber capabilities.

Geopolitical competitors quickly exploited the resulting domestic friction, with Chinese tech giant Alibaba launching a massive distillation attack involving 28.8 million queries across 25,000 fraudulent accounts to systematically extract the proprietary capabilities. While Anthropic lobbied Washington and filed multiple lawsuits to protect its market position against open-source rivals, Beijing accelerated its own domestic development, with industry leaders projecting a Chinese Fable 5-class rival to emerge ahead of schedule. Although the export controls were ultimately lifted, sustainable American dominance in this critical technology sector requires closer strategic alignment between private tech firms and federal defense authorities to prevent critical intellectual property theft.

Comment
Modern defence strategies require absolute alignment between private technology firms and state authorities. Commercial entities often prioritise market dominance over sovereign security protocols. This friction creates critical vulnerabilities for adversaries to exploit through asymmetric cyber operations. Democratic states must establish clear legal mechanisms to secure critical intellectual property.
